Pre-Order Terms of Sale

These Pre-Order Terms apply to all orders placed for the Dtablet device before general availability. They apply in addition to our Terms of Use. Where they conflict, these Pre-Order Terms govern.
Please read section 3 carefully. It describes a material risk to your order.
1. Who you are buying from
Dtablet AS, a limited company registered in Norway under organisation number 934 659 155, with registered address Krambugata 2, 7011 Trondheim, Norway. Contact: hello@dtablet.com
Dtablet AS is the seller for all orders, in all markets.
2. What a pre-order is
A pre-order is a binding purchase of a product that has not yet been manufactured. By placing a pre-order you:

pay the full purchase price at the time of ordering;
-
reserve a unit from the first production run;
-
receive the product only after manufacturing is complete.
There is no delivery before the estimated delivery date set out in section 4. No partial delivery, sample, or early unit is available at any price.
3. The pre-sale is conditional — please read
Dtablet is an early-stage company. The purpose of this pre-sale is to establish whether there is enough demand to fund manufacturing of the product and continued development of the product and its companion application.
This means:

Your payment will be used to develop and manufacture the product. It is not held in escrow and it is not held untouched until delivery.

Delivery depends on the pre-sale reaching the level required to manufacture. If we do not reach that level, the product will not be manufactured and will not be delivered.

We will decide whether to proceed by January 2027. We will notify all customers of that decision by email.

If we do not proceed, every pre-order will be refunded in full, automatically, within 30 days of that decision. You do not need to request it.
We hold a reserve against cancellations, but we want to be direct with you: as with any purchase from an early-stage company, there is a risk that Dtablet AS becomes unable to deliver or to refund. If that risk is not acceptable to you, please do not place a pre-order.
You may cancel at any time before delivery for a full refund. See section 7.
4. Estimated delivery
Estimated delivery: April 2027.
This is an estimate based on our current manufacturing and development plan, not a guaranteed date. Manufacturing has not yet begun and a manufacturing partner has not yet been selected.
If the estimate changes, we will notify you by email with a revised estimate and the reason.
Outer limit. If we have not delivered your order by end of Q3 2027, we will contact you and offer a full refund. You do not have to accept it; you may choose to keep your order active and wait.
This does not limit your right to cancel at any earlier time under section 7, or your statutory rights under section 10.
5. Price and payment
The full purchase price is charged when you place your order.
Value added tax (MVA). Dtablet AS is not currently registered for Norwegian VAT. Prices shown do not include and are not subject to Norwegian MVA at the time of your order. If Dtablet AS becomes VAT-registered before your order is delivered, the price you paid will not change. Any VAT that becomes payable will be borne by Dtablet AS.
United States. US customers may be able to pay using a pre-tax health account (HSA or FSA) through our payment partner Truemed. See section 6.

6. Payment with a health account (US customers only)
We offer Truemed as a payment option for customers in the United States. Truemed is an independent third party that determines whether your purchase qualifies as a medical expense and, where it does, issues a Letter of Medical Necessity.
Please note:

Eligibility is determined by Truemed and your plan administrator, not by Dtablet AS.

Dtablet AS gives no tax advice and makes no representation that your purchase will qualify as a reimbursable or tax-advantaged expense.

Timing matters. Tax rules generally treat a medical expense as incurred when the product is received, not when it is paid for. Because delivery is estimated for April 2027, a purchase made with Flexible Spending Account (FSA) funds may fall outside the plan year in which those funds must be used. Please confirm the treatment of a deferred-delivery purchase with your plan administrator before ordering.

Refunds on orders paid through Truemed are returned to the originating health account, not to a card or bank account.
Your use of Truemed is also governed by Truemed's own terms and privacy policy.
7. Cancellation and refunds
You may cancel your pre-order at any time before delivery, for any reason or no reason, and receive a full refund of everything you paid.
To cancel, email hello@dtablet.com from the address used to place the order, or use the cancellation form in our Right of Withdrawal and Returns Policy.

Refunds are issued to the original payment method. Orders paid through Truemed are refunded to the originating health account.

We will process refunds without undue delay and in any case within 14 days of receiving your cancellation.

There is no cancellation fee, restocking fee, or deduction of any kind.
This right is offered voluntarily and is more generous than the law requires. It sits alongside, and does not replace, your statutory rights.
8. Changes to the product
The product is still in development. Final specifications, materials, colours, packaging and software features may differ from those shown at the time of your order.
We will not make changes that materially reduce the core function of the product without notifying you first. If we notify you of a material change and you do not want to proceed, you may cancel for a full refund under section 7.
The companion application is not yet developed. Nothing in these terms is a commitment to any particular application feature, platform or release date. Separate terms will be provided before the application becomes available.
9. Order acceptance and limits
Your order is accepted when we send you an order confirmation by email.
We may cancel an order and refund you in full where:

the product was listed at an incorrect price due to an obvious error;

we reasonably suspect fraud or reselling;
-
we are unable to ship lawfully to your address; or
-
the pre-sale does not proceed under section 3.
10. Your statutory rights
Norway. You keep all rights under forbrukerkjøpsloven and angrerettloven, including the right of withdrawal and the right to complain about defects (reklamasjonsrett). Nothing in these terms limits those rights.
United States. Dtablet AS applies Norwegian consumer protection law as a minimum standard to US customers as well. Where mandatory law in your state gives you greater protection, that law applies instead.
We ship only to Norway and the United States. See our Shipping Policy.
Dtablet AS gives no separate commercial guarantee beyond what follows from forbrukerkjøpsloven, unless expressly stated for a particular purchase.
11. Governing law and disputes
These terms are governed by Norwegian law. Disputes are subject to the jurisdiction of the Norwegian courts, with Trøndelag tingrett as legal venue.
If you are a consumer, this does not deprive you of the protection of mandatory rules of the law of the country where you live, and does not prevent you from bringing proceedings where mandatory local rules allow.
Before going to court, we encourage you to contact us at hello@dtablet.com. Norwegian consumers may also bring a complaint to Forbrukerrådet (forbrukerradet.no).
12. Changes to these terms
We may update these terms for future orders. The version that applies to your order is the version published when you placed it, and we will keep a copy available on request.
